CONTRACTOR AND CONTRACTOR


The terms below apply to the services offered by INTENSITY TRAINNING CONSULTING, to people over 18 years of age or minors with permission from a parent or guardian;
The identified parties have agreed upon this Technical Consultancy Services Provision Contract for a fixed term, which will be governed by the following clauses and the conditions described herein.


OBJECT OF THE CONTRACT


Clause 1.  As the CONTRACTED PARTY is a Physical Education Professional working in the  FITNESS CONSULTING Area, the contract aims to provide consultancy, set up and develop an  individualized training strategy via online, within the individualities of each person, the contractor   ;will send a physical assessment (if applicable), three  (3) photos are required in anatomical position, full body front, full body back, full body left side or right side, must be delivered  by the contractor, to the CONTRACTOR develop the training strategy.


Clause 2. The CONTRACTOR declares that he is clinically fit to perform all physical exercises determined by the CONTRACTED PARTY, therefore, if he suffers from any pathology that may limit his training, this exempts the CONTRACTED PARTY from any responsibility, omitting the CONTRACTOR to be a carrier of any type of disease.


Clause 3. The term of this CONTRACT is MONTHLY, QUARTERLY or TRI-MONTHLY, starting from confirmation of payment. It can be renewed for the same period or longer when it ends. The training strategy will arrive within 5 (five) business days after confirmation of payment and completion of the CONTRACTOR's profile form.


Clause 4.The training programs must be carried out in a Gym, or in a place with a similar structure and qualified professionals to assist the exercises.       


Clause 5. All consultancy will be carried out online, with the CONTRACTOR being fully responsible for carrying out the exercises. 


Clause 6.  This consultancy is not for preparing athletes.


Clause 7. The content of the information contained in the customer profile questionnaire is the responsibility of the CONTRACTOR. The CONTRACTED PARTY will use such information to prepare the training strategy and any omitted information is the responsibility of the CONTRACTOR. If the CONTRACTOR wants to change any data in a questionnaire to resend a new training installment, they must purchase the product again.


Clause 8.The routine described by the CONTRACTOR in the customer profile questionnaire must be maintained for the term of the contract. Any changes to the CONTRACTOR's routine will not be used by the CONTRACTOR to prepare a new training plan within the same contract.

Clause 9. The CONTRACTOR will be available to the client during business hours from Monday to Friday during business hours in the State of Florida. The CONTRACTOR will be answering questions via WhatsApp and email.


Clause 10.Consulting services will be paid through PayPal or PagSeguro, according to the CONTRACTOR's choice.


Clause 11.To resolve any disputes arising from the contract, the parties elect the forum demarcated by Macaé RJ.


Clause 12 After paying for the chosen plan, the CONTRACTOR will have 24 hours to cancel without any penalty. Otherwise, the CONTRACTOR will not be entitled to a 100% refund.
